What is divorce mediation in Florida?
Mediation is a confidential, alternative dispute resolution process where a neutral third party (the mediator) helps you and your spouse negotiate a settlement without going to trial.
Is mediation mandatory in Osceola County?
Yes. In almost all Florida family law cases, judges require both parties to attend mediation before they will schedule a final contested trial.
Does the mediator make decisions for us?
No. A mediator does not act as a judge and cannot force you to agree to anything. They are there to facilitate communication and help you find mutually acceptable solutions.
What happens if we reach an agreement during mediation?
If an agreement is reached, the mediator will draft a Marital Settlement Agreement. Once both parties sign it, it is submitted to the judge for approval, making it a legally binding court order.
What if we cannot agree on everything?
Any issues you resolve can be put into a partial agreement. Any unresolved issues will be declared an “impasse” and will be left for the judge to decide at trial.
Do I need my own lawyer during mediation?
While not legally required, it is highly recommended. The mediator cannot give you legal advice. Having your own attorney ensures your rights are protected and that you fully understand the long-term consequences of any agreement.
How long does mediation usually take?
A typical mediation session lasts between 3 to 4 hours, depending on the complexity of the issues. Some highly contested cases may require multiple sessions.
