How is child support calculated in Florida?
Florida uses standard Child Support Guidelines. The formula looks at both parents’ net incomes, the cost of health insurance and daycare, and how many overnight stays the child has with each parent.
Can I modify my child support payments?
Yes, if there has been a “substantial change in circumstances.” This could include a significant job loss, a major increase in the other parent’s income, or a change in the child’s needs or the parenting timesharing schedule.
What happens if my ex stops paying?
We can file a motion for contempt and enforcement. The court has the power to garnish their wages, seize their tax returns, suspend their driver’s license, or even order jail time until the debt is paid.
Do I still have to pay support if I am not allowed to see my child?
Yes. Under Florida law, child support and timesharing (visitation) are two separate issues. You cannot withhold support because you are being denied visits, and a parent cannot deny visits because support hasn’t been paid. Both require court intervention to fix.
When does child support end in Florida?
Generally, child support ends when the child turns 18. However, if the child is still in high school and is reasonably expected to graduate before turning 19, support may continue until graduation. It can also be extended for children with special needs.
Can my ex and I agree to waive child support?
No. Under Florida law, child support is a right that belongs to the child, not the parents. A judge will not approve a parenting plan that waives child support entirely if the state guidelines indicate it is required.
What if the other parent quits their job to avoid paying?
If a parent is voluntarily unemployed or underemployed to avoid paying support, the court can “impute” income. This means the judge will calculate support based on what that parent could or should be earning based on their recent work history and qualifications.
