How long does a divorce take?
If it is uncontested, it can be finalized in 4 to 6 weeks. A contested divorce can take 6 months or longer.
Do I have to go to court?
Not necessarily. Most Florida cases are resolved through mediation without needing a trial.
Who gets the house?
Florida divides property fairly, but not always 50/50. If there are children, the primary custodial parent often remains in the home.
Is Florida a “no-fault” divorce state?
Yes. You do not need to prove fault (such as adultery or abandonment) to get a divorce. You simply need to state to the court that the marriage is “irretrievably broken.”
Do we need to be legally separated before filing?
No. Unlike some other states, Florida does not actually have a status of “legal separation.” You can file for a divorce at any time, provided at least one spouse has been a resident of Florida for a minimum of six months.
How is child support calculated?
Florida relies on strict Child Support Guidelines. The calculation factors in both parents’ net incomes, health insurance costs, childcare expenses, and the number of overnight stays each parent has with the child throughout the year.
Will I have to pay or receive alimony?
Alimony is not automatic. The court evaluates one spouse’s actual financial need and the other spouse’s ability to pay. Judges also heavily weigh the length of the marriage and adhere to Florida’s recently updated alimony formulas to ensure fairness.
